Reader’s Question:

Is it true that if I take the driver improvement course in Arizona there will be no points charged to my license or increase in my auto insurance rate premiums?

Ben

Catalina Foothills, AZ

If you receive a ticket for a non-criminal traffic violation and elect to attend a basic driver improvement course in Arizona there should be no points on your driving record. If, as a result of a traffic violation, you elect to attend and complete a basic driver improvement course, you will receive the following advantages:

1. Your insurance rates will not go up and your car insurance policy cannot be cancelled because of this infraction, unless this involved an accident where you were at fault.

2. Points may not be added to your driving record, adjudication of guilt is withheld, the fine is reduced up to 18% and safe driver status is maintained if applicable.

Reader’s Question:

Is a car rental agency liable to the damages to my vehicle if the person they rented the vehicle to does not have auto insurance at all in Peoria AZ?

Mike

Peoria, AZ

It will depend upon laws of the state if the rental car company can be held liable for the damages caused by a motorist who rented from them and caused an accident and without car insurance. A person renting a car typically signs a rental agreement which puts responsibility for damages caused in an accident on the renter.

Though many people believe that rental car companies will assume full responsibility for the vehicles they rent, in most states, rental car companies are not obligated to take responsibility for the actions of their rental motorists including Arizona.

If you were hit by an uninsured driver driving a rental car in Peoria AZ, you should contact the car rental company to see if they are going to take responsibility for the damages their renter have caused. If they are not, then you can contact Arizona insurance regulator or a lawyer to find out the state law that requires rental car agencies to do in this type of situation.
